1. Overview

This website is operated by NinVendor. Throughout the site, the terms “we”, “us” and “our” refer to NinVendor. By accessing our website, placing an order, or using any part of our services, you agree to be bound by these Terms of Service, together with our Refund Policy, Delivery Policy, Privacy Policy, and any other policies or notices published on this website.

If you do not agree to these Terms, you must not use this website or purchase from us.


2. Nature of the Service

  • NinVendor sells digital in-game products and related digital services for supported Pokémon games.
  • Delivery is performed digitally in-game via Link Trade only, unless explicitly stated otherwise.
  • Pokémon HOME Transfer is not offered as a delivery method.
  • Our services depend on third-party platforms, games, networks, and services, including but not limited to Nintendo systems, Nintendo Online services, Pokémon games, Pokémon HOME compatibility rules, payment processors, hosting providers, and internet infrastructure.

3. Eligibility and Acceptable Use

  • By using this website, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.
  • You agree not to use the website or our services for any unlawful, fraudulent, abusive, or unauthorized purpose.
  • You must not interfere with, disrupt, reverse engineer, scrape, overload, probe, or attempt to gain unauthorized access to the website, ordering systems, trade systems, or related infrastructure.

4. Orders

  • All orders are subject to acceptance and availability.
  • We reserve the right to refuse, limit, cancel, or hold any order where we reasonably suspect fraud, abuse, duplicate claims, payment risk, policy evasion, technical misuse, resale activity, or other conduct that may harm us, our systems, or other customers.
  • You must provide accurate and complete account, payment, and contact information when placing an order.
  • If you provide incorrect information, use the wrong game, fail to meet delivery requirements, or make invalid selections, this may delay, alter, or prevent fulfilment of your order.

5. Customer Responsibility for Selections

  • It is your responsibility to ensure your selections are valid, compatible, and appropriate for the game you are purchasing for.
  • If you select content, attributes, or options that are invalid, illegal, incompatible, unavailable, or not tradable, we may remove, substitute, or adjust those selections as part of fulfilment.
  • Items sold as random, including but not limited to Mystery Pokémon and Mystery Eggs, are delivered on a random basis and cannot be customized unless explicitly stated otherwise.

6. Legality Adjustments

  • Our systems are designed to ensure traded Pokémon comply with in-game legality and tradeability requirements.
  • If a purchased Pokémon contains traits it cannot legally possess or that would prevent valid in-game trade or use, we may automatically modify, remove, or correct those traits before delivery.
  • This may include, without limitation, moves, abilities, forms, levels, balls, ribbons, marks, nicknames, items, or other attributes.
  • These corrections are part of the service. You are not entitled to a refund, replacement, or claim solely because an illegal or incompatible selection was corrected or removed.

7. Delivery and Fulfilment

  • Orders are fulfilled through our in-game delivery system, referred to on the site as the Vending Machine.
  • To receive your order, you must have the correct supported game, access to the internet, and the ability to complete an in-game Link Trade.
  • You must also maintain a stable connection on the device used to access the website during the trade session, as interruptions may cancel or delay the trade.
  • Orders are generally made available soon after purchase, but fulfilment times may vary depending on service load, platform status, maintenance, outages, compatibility issues, game or system updates, and other operational factors.

8. Temporary Outages, Maintenance, and Compatibility

  • No technology is immune to downtime, defects, errors, interruptions, maintenance, compatibility issues, or third-party disruptions. This includes our bots, website, hosting, payment systems, Nintendo services, game servers, and game or system software.
  • Temporary outages, delays, suspensions, maintenance periods, update-related downtime, or compatibility interruptions do not by themselves constitute a fault requiring refund, chargeback, or cancellation, provided we continue to honour and fulfil the order once service is reasonably restored or a workable fulfilment path is available.
  • We may suspend, modify, delay, or temporarily withdraw services where reasonably necessary for maintenance, security, compliance, technical changes, or compatibility with third-party platforms.

9. Pokémon HOME and Transfer-Only Limitations

  • Some Pokémon available in our store are not native to the game they are purchased in and are only obtainable there via transfer from Pokémon HOME.
  • As a result, certain Pokémon may not be transferable back into Pokémon HOME after trade, even if they can exist and function normally within the game itself.
  • By purchasing, you acknowledge and accept this platform limitation.
  • This limitation does not constitute a defect in the product or service and is not grounds for refund merely because a Pokémon cannot be transferred into or back into Pokémon HOME.

10. Prices and Product Information

  • Prices, product availability, supported games, supported species, supported items, and service features may change at any time before purchase.
  • We aim to describe products and services accurately, but errors may occasionally occur.
  • If we discover an obvious pricing, listing, compatibility, or content error, we may cancel or correct the affected order and, where appropriate, issue a refund for any amount paid for the affected item.

11. Refunds and Payment Disputes

  • Refunds are governed by our Refund Policy, which forms part of these Terms.
  • You agree not to initiate a payment dispute or chargeback without first contacting us and giving us a reasonable opportunity to resolve the issue.
  • Where an order has been accessed, prepared, partially fulfilled, delivered, or made available for collection, we may contest any chargeback or payment dispute with relevant evidence, including order records, website interaction logs, and fulfilment records.
  • Nothing in this section excludes any rights you may have under applicable consumer law.

12. Immediate Performance of Digital Content / Digital Services

  • By placing an order for our digital in-game products and related digital services, you expressly request and consent to us beginning performance immediately, including order processing, preparation, validation, and making the order available through the Vending Machine for in-game collection.
  • Where the law of your jurisdiction provides a cancellation or withdrawal period for digital content or digital services supplied at a distance, you acknowledge that, to the extent permitted by law, that right may be lost or reduced once immediate performance has begun.
  • If your jurisdiction requires a separate consent or acknowledgment for loss of a cancellation or withdrawal right, that consent or acknowledgment may be obtained during checkout or before order access is provided.

13. Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, or remedy that cannot lawfully be excluded, restricted, or modified under applicable law, including the Australian Consumer Law where it applies.

Where the law permits us to limit our liability for a breach of a non-excludable guarantee or other non-excludable right relating to services, our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.


14. Disclaimer of Warranties and Limitation of Liability

  • To the maximum extent permitted by law, the website and services are provided on an “as is” and “as available” basis.
  • We do not warrant that the website or services will be uninterrupted, error-free, continuously available, compatible with every update or device, or free from third-party disruption.
  • To the maximum extent permitted by law, we are not liable for indirect, incidental, special, exemplary, or consequential loss, including loss of opportunity, loss of enjoyment, loss of data, loss of profit, or loss arising from platform restrictions imposed by Nintendo, Pokémon HOME, game publishers, or other third parties.
  • To the extent permitted by law, our total liability arising out of or in connection with any single order is limited to the amount paid for that order.

15. Intellectual Property and Third-Party Rights

  • Unless otherwise stated, the website text, site layout, branding created by NinVendor, original graphics created by NinVendor, software, code, systems, and other original content created by us are owned by NinVendor or used by us with permission where applicable.
  • Certain names, logos, game titles, character names, screenshots, artwork, images, and other game-related materials appearing on this website may be the intellectual property of third parties, including Nintendo, The Pokémon Company, Game Freak, Creatures Inc., and other respective rights holders.
  • All such third-party intellectual property remains the property of its respective owner.
  • NinVendor is an independent seller and is not affiliated with, endorsed by, sponsored by, or approved by Nintendo, The Pokémon Company, Game Freak, Creatures Inc., or any related rights holder.
  • References to third-party names, games, products, services, and trademarks are used for identification, compatibility, descriptive, and informational purposes only.
  • You must not copy, reproduce, republish, distribute, sell, scrape, or commercially exploit any original content, site systems, or branded material owned by NinVendor without our prior written permission.

16. Third-Party Services and Links

  • Our website and services may rely on or link to third-party services, platforms, tools, or websites.
  • We are not responsible for the operation, availability, content, policies, or practices of third-party services that we do not control.

17. Suspension and Termination

  • We may suspend, restrict, or terminate access to the website or our services where we reasonably believe you have breached these Terms, engaged in fraud or abuse, created unacceptable risk, or interfered with our operations.
  • Termination does not affect any accrued rights, payment obligations, dispute rights, or clauses intended to survive termination.

18. Changes to These Terms

We may update these Terms from time to time by publishing a revised version on this website. The version in force at the time you place an order will apply to that order unless a change is required by law or is expressly stated to apply earlier.


19. Governing Law and Mandatory Consumer Rights

These Terms are governed by the laws of South Australia, Australia, except to the extent that the mandatory consumer protection laws of another jurisdiction apply to you and cannot lawfully be excluded or limited by contract.

If you are a consumer residing outside Australia, you may also have rights under the consumer protection laws of your country of residence. Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded, restricted, or modified under applicable law.

Subject to the paragraph above, you and we submit to the non-exclusive jurisdiction of the courts of South Australia, Australia.
